28 New Articles Added to the Local Legislative Rules of Shaanxi (Revised Draft)

(Liu Bing) At 15:00 January 26th, the second conference for fourth session of the 12th People’s Congress was held, on which An Dong, deputy chairman of the Standing Committee of the Provincial People’s Congress, gave statement on Local Legislative Rules of Shaanxi (Draft).

Passed and executed since February 19th, 2001 when the Fourth Session of the 9th People’s Congress of Shaanxi Province was held, the Local Legislative Rules of Shaanxi (Draft) has played significant roles in standardizing and promoting local legislation, maintaining unification of legal system, and accelerating democracy and legal system building for Shaanxi. However, with continual development of economic society and complete and deep development of renovation in Shaanxi, new requirements are required for enhancing and improving legislation.

On March 2015, the Third Session of the 12th National People’s Congress modified and adopted the new legislative law by giving great modification and perfection on perfecting legislative system and promoting scientific and democratic legislation as well as granting local legislation right for city. Based on the actual condition, the Standing Committee of People’s Congress of Shaanxi Province included modification of provincial legislative rules into the annual legislation plan immediately at beginning of 2015. After forming the draft (exposure draft), it is modified repeatedly by symposium, primary research, and listening comments from various departments, sections and organizations, and then the modified draft (view draft) is formed. In September, it was viewed by the 22th session and then the revised draft (secondary view draft) was proposed based on comments from all aspects. Then, it was viewed by the Standing Committee of People’s Congress of Shaanxi Province again in November.

During this period, the Standing Committee of People’s Congress of Shaanxi Province assign specific persons to participate in research and discussion organized by the Standing Committee of People’s Congress of Xi’an City to listen to views and suggestion of 101 members directly. In addition, it also visited general legislation stations and listened views from enterprises, cadres from communities, and masses. Finally, the revised draft was revised from 62 clauses under 9 chapters into 90 clauses under 6 chapters, it means 28 clauses were added. The revised clauses mainly involve in structure, applicable scope, and legislation principles of the rules, playing dominated role of NPC in local legislation, promoting scientific and democratic legislation deeply, setting municipal local laws, and modifying local governmental rules.
